Terms & Conditions

1. Acceptance

By creating an account or placing an order on Eatoshi you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. The service

Eatoshi is a marketplace that connects customers with independent restaurants and couriers in the UAE. We are not the seller of the food; the restaurant is. We are not the courier; the courier is an independent contractor or third-party fleet.

3. Eligibility

You must be at least 18 years old and legally able to enter a contract. You are responsible for the accuracy of the account and order information you provide.

4. Orders

• An order is an offer to buy. The contract for the food is formed between you and the restaurant when the restaurant accepts.
• Restaurants may reject orders for any reason, including stock-outs, closing time, or area not served.
• Estimated delivery times are estimates, not guarantees.
• Allergens and ingredient information are provided by the restaurant. If you have allergies, contact the restaurant directly before ordering.

5. Pricing & fees

Prices are shown in AED and include applicable VAT. Delivery fees, service fees, and tips are shown before checkout. Crypto-equivalent amounts are calculated at checkout using a live market rate and locked for a short window. The amount you actually send must match the locked crypto amount.

6. Crypto payments

• You are responsible for selecting the correct network and sending to the correct address shown for your order. Funds sent to the wrong network or address may be permanently lost.
• You must send the exact locked amount within the payment window. Late, partial, or over/underpaid transactions may delay or void the order.
• On-chain transactions are irreversible. Once confirmed, only the restaurant or Eatoshi can issue a refund, on the same network, less network fees.
• Eatoshi is not a money transmitter, custodian, exchange, or wallet provider. We never hold your private keys.

7. Cancellations & refunds

You may cancel an order before the restaurant accepts it. After acceptance, cancellation is subject to the restaurant's policy. If an order is rejected, undelivered, or materially wrong, you may request a refund through the order page. Refunds are issued to the original payment method (or original crypto address) where possible.

8. Acceptable use

Do not abuse, defraud, harass, or impersonate; do not use the service for illegal purposes; do not attempt to break or probe our systems; do not use the platform to launder funds. We may suspend or terminate accounts that violate these rules.

9. Restaurants & couriers

Restaurants are responsible for food quality, hygiene, licensing, allergens, and accuracy of menus and prices. Couriers are responsible for delivery handling. Eatoshi facilitates the marketplace and on-chain settlement; we are not liable for the underlying food or delivery beyond our role as platform.

10. Intellectual property

The Eatoshi name, logo, and platform are owned by us. You get a limited, non-exclusive, non-transferable licence to use the platform for personal, non-commercial use.

11. Disclaimers

The platform is provided "as is" and "as available". To the maximum extent permitted by UAE law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Crypto markets are volatile and on-chain transactions carry risk; you use them at your own risk.

12. Liability

To the maximum extent permitted by UAE law, our total liability for any claim arising out of the service is limited to the value of the order in question. We are not liable for indirect, incidental, or consequential losses, or for losses caused by sending crypto to the wrong network, address, or chain.

13. Governing law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Disputes are subject to the exclusive jurisdiction of the courts of Dubai.

14. Changes

We may update these Terms; the new version takes effect when posted. Continued use after changes means you accept the updated Terms.
